The court initiates a lawsuit against the alleged nephews of Silvio Santos

The XI Family and Inheritance Court of São Paulo rejected the lawsuit brought by Guilherme Augusto Marques and Hugo Sérgio Marques, who claimed to be nephews of presenter Silvio Santos. The decision was taken last Friday (17th), ordering the dismissal of the case without analysis on the merits.

According to the IG, the applicants requested recognition as descendants of the entrepreneur and inclusion in sharing the inheritance of the founder of SBT. The Court found that the case had already been adjudicated previously and that there was no need for a new assessment.

The trial originates from an action initiated in 1996 by Hugo Sérgio Marques, father of the current applicants, who claimed to be the biological son of Silvio Santos. According to court documents, Hugo claimed to be the result of an affair between the host and Wilma Marques in the 1950s.

At the time, the Court of Justice of São Paulo concluded that the evidence presented did not prove the family connection. During that trial, Silvio Santos did not show up for six scheduled hearings and did not take the DNA test required by the court.

With the death of Hugo Sérgio in 2015, at the age of 58, the case stopped. In March 2025 the children resumed the legal case, requesting a DNA test through the exhumation of the presenter’s remains or using genetic material from the entrepreneur’s daughters.

The official heirs – Cintia, Silvia, Patricia, Rebeca and Renata Abravanel – contested the request through their lawyer, Luiz Kignel. The defense argued that the case had already been decided two decades ago and that the new action would violate the principle of res judicata.

Judge Claudia Caputo Bevilacqua Vieira accepted the heirs’ arguments and ordered the case dismissed. The authors of the appeal were sentenced to pay R$20,000 in legal costs, despite having obtained the benefit of free justice.

The fortune left by Silvio Santos, who died in 2024, is valued at R$6.4 billion, including amounts held abroad. Documents available from business councils indicate that the presenter owned approximately R$3.9 billion in real estate, miscellaneous assets and business interests.
