In the petition, Adnet’s lawyers claim that Frias “exploded in rage, with threats, insults and defamation after learning of a simple and harmless parody made by the author, in which he mimics the defendant’s speech, in an official video. of the Communication from the Secretariat of the Federal Government “.
Also according to Adnet’s team, the perpetrator of the action did not commit any offense or attack in his parody. “There is no hate speech or intolerance to justify the reaction of the Federal Government’s Special Secretary for Culture.”
The defense of the Bolsonarist argued that there was no demonstration of a specific intent to offend and that the facts were atypical.
Judge Fernando Brandini Barbagalo, on the other hand, ordered the continuation of the criminal action, proposed by lawyers Guilherme Furniel and Maíra Fernandes on behalf of Adnet. He stated that the expressions contained in the publication on his personal profile indicate, in theory, the animus to offend the victim’s honor.
The magistrate also designated a videoconference hearing for the hearing of the parties involved.
