The São Paulo Civil Police concluded the police investigation which investigated whether a joke by comedian Leo Lins was offensive and charged him with the felony of skilled injuries. Published on Instagram in April, the joke joked about the voice of a child with cerebral palsy.
“I know the right thing is deaf and not deaf-mute, but if I had such a voice, I’d rather be deaf,” Lins said.
After protests at his shows, the comedian shared the sounds of seals and made fun of people with disabilities again. “At least it will be a silent protest,” he said.
Annoyed, two people with disabilities filed a complaint at the 1st DPPD (police station for people with disabilities) in Sao Paulo.
One of the whistleblowers was digital influencer Ivan Baron, who has a motor disability and fights for social inclusion. Leo Lins accused Baron of taking an old video with the joke to “seal it” and cause it to “erase”.
According to the police report, the officers concluded that the comedian wanted to offend people with disabilities for free. The investigation also says he refused to give his version of him when he was called to testify.
Leo Lins even went to the police station, but accused the local delegate of asking for his indictment in the action even before giving his version. “The deputy claims that the delegate entered the place and said that she had already deliberated on her indictment even before her version was given and that, therefore, she would not have answered any questions”, reads the document, leaked to the press.
Upon completion of the investigation, the police found that Leo Lins had committed a series of abusive practices. The São Paulo Civil Police Office confirmed the allegation, but did not comment on Leo Lins’ allegations.
“The case was investigated through a police investigation opened by the 1st Police Headquarters for People with Disabilities, and was reported to Justice in September this year with the indictment of the author for the crime of inciting discrimination against of a person due to a disability, “the police note said.
Now it is up to the Public Prosecutor to accept the opening of the case so that he becomes a defendant.
Discrimination against a person because of his or her disability is subject to a criminal suit for qualified injury, the penalty of which is one to three years of imprisonment and a fine. But the penalty increases in the event of a repeat offense.
In August, the Sao Paulo Court of Justice (TJSP) sentenced Leo Lins to pay R $ 44,000 in compensation for moral damages to Adriana Cristina da Costa Gonzaga, the mother of an autistic boy.
The action was brought in 2020, after the publication of a video on the profile of Aline Mineiro, the girlfriend of Leo Lins. At the time the former “A Fazenda” said: “As in all parties, he doesn’t say anything, he’s a bit autistic”.
