Nicolás Vallejo-Nágera, known as Colate, has lost a custody battle against his ex-wife, Mexican singer Paulina Rubio, after a Miami judge ruled that their 15-year-old son, Nico, must live with his mother in Florida.

The ruling closes years of litigation over custody of the boy, whom the former couple had three years after marrying in 2007. The decision came just after Colate and Nico had spent much of the summer together in Spain.

Rubio has not commented publicly on the ruling, though her lawyer has spoken out. Hours after learning the result, Colate posted photographs with Nico from this year's vacation, saying a summer full of memories was ending and that, despite everything they had been through, nothing could break their love, adding that he loved Nico.

Colate plans to appeal

During the Spanish television program "Fiesta" on August 9, journalist Kike Calleja reported that the ruling had already been issued. Fellow journalist Pipi Estrada said he had spoken by phone with Nicolás, who told him he intended to appeal the judge's decision.

Colate, the father of the boy, whose full name is Andrea Nicolás, had accused his ex-wife of mistreating their son, but the allegations could not be proven, a factor that led the judge to rule in Rubio's favor. According to Fiesta, the teenager's own statements may have worked against Colate, even though he has consistently maintained that his son wants to live permanently in Spain.

Nico to live with half-brother in Florida

While Colate decides whether to appeal, the latest dispute between the former couple means Nico will live at Rubio's home in Florida. There he will live with his half-brother Eros, born from Rubio's relationship with Mexican artist Gerardo Bazúa.
