Netflix users cancel subscriptions and report new charges to Procon




Users were furious with Netflix’s decision to charge extra for sharing passwords. On social networks, members have published complaints and even threatened to delete their profiles.

On Twitter, the hashtag “Cancelled” became one of the most commented topics this Wednesday (24/5). Among the posts, internet users claim to have activated the Consumer Code and to have filed a complaint with the Consumer Protection and Defense Program (Procon).

“Netflix announced yesterday that it will charge an additional BRL 12.90 per month for users who share their platform passwords with other people outside their home. But the charge cannot be made because it is an abusive complaint to Procon Recife,” he stated a user.

In the same post, the internet user shared the complaint opened to Procon, in which she stated that the accusation “violates the Brazilian civil code (art. 70 and art. 71) and the consumer defense code (art. 51)” . He also noted that the rate is “manifestly excessive, pursuant to article 39 of the Consumer Code).”

In addition to the hashtag, the term “R$ 12.90” popped up on the social network after complaints about the rate deemed abusive. Internet users have pointed out that the new charge can be claimed for ‘tied selling’, when the purchase of one product or service is conditional on the purchase of another.

“I canceled the Netflix plan I had since 2016. I only subscribed because of my family (who live around 100 km away). My grandchildren love to watch cartoons, but it’s impossible to pay for them. Brazil is the second Country with more subscribers and I hope they lose everything,” said one profile.

Due to the repercussions, Procon-SP has notified the company to provide clarification to the subscribers. According to the agency, Netflix must explain whether it is adopting a new billing policy and how this eventual system will work. The notification also intends to analyze possible infringements.

In a statement, Procon-SP has asked Netflix-reported users to register formal complaints about the site if they feel the charge is irregular and undue.

“Only with proof of the changes and formalization of complaints will it be possible to assess whether the new form of pricing for access or the technology used for control has legal support in the Consumer Protection Code”, explained Rodrigo Tritapepe, Director of the Service and orientation at Procon-SP.
