The Superior Court of Justice (STF) suspended this Thursday (29/6) the action of Rose Miriam for the recognition of the stable union with Gugu Liberato (1959-2019). The interim decision was issued after a request from Thiago Salvático, the presenter’s alleged boyfriend.
According to Minister Nancy Andrighi, there is a “procedural mismatch” between the lawsuits of Salvático and Rose Miriam, who seek to prove intimacy with the late presenter of “Domingo Legal”.
“The action for the recognition of a stable union proposed by the applicant [Salvático] was judged to have been extinguished without a decision on the merits even before the summons of the defendants,” said the minister, describing Rose Miriam’s trial as “at a very advanced stage in the proceedings”.
The minister’s decision also says that the uneven course of trials can be harmful. “Given this scenario, the procedural discrepancy between the two actions is incontrovertible and clearly harmful not only to the plaintiff [Salvático]but until the very discovery of the truth about the presumed relationship between the parties and the person [Gugu] with whom they claim to have maintained a stable union in a concomitant period, with family and inheritance repercussions that will have to be properly investigated”, he said.
Rose Miriam’s next hearing was scheduled for next Monday (7/3), but has been cancelled. Meanwhile, Thiago Salvático has 48 hours to present new documents demonstrating the progress of the action promoted by the stable union.
Gugu’s stable union
Last week, Thiago Salvático celebrated the decision of the São Paulo court to reevaluate his request for recognition of a stable union with the presenter, a request that had been canceled in January this year. The Tribunal allowed the case to be reopened, giving Salvatico a new opportunity to claim a part of Gugu Liberato’s inheritance. The amended court decision was published in the e-Justice Journal.
The change of status of Salvático’s request was promoted by Judge Galdino Toledo Júnior and documented in the Electronic Diary of Justice, resulting in the postponement of the trial to first instance so that the presenter’s family is summoned and can respond to the appeal presented.
In January 2023, the request for a stable union was rejected by the Justice, when the competent judge decided to extinguish the action without judging on the merits. Salvático, who questioned the conduct of the magistrate who extinguished the action, had yet another victory: the judge sent the “suspect” for analysis by the Tribunal’s Special Chamber.
