A follower asks eyewear brands and influencers for compensation of R$50,000
A follower, whose name was not revealed, is suing the influencers Virginia Fonseca AND Gabi Brandt for moral damages for having purchased and not received products from an accessories brand advertised by them on social media.
The newspaper’s editorialist made this known Metropolis Fábia Oliveira this Monday 25. According to her, the follower purchased six glasses from the BC Comércio de Acessórios brand, also known as ‘BY IK’, after seeing the articles promoted by the two influencers.
According to the document, the woman reports that the delivery deadline was seven days, but it was not respected. She also claims that she contacted the company in an attempt to cancel the order, but received no response.
Due to the inconvenience, he requests compensation of R$ 168.52 for moral damages. Furthermore R$50 thousand for material damage, with R $ 10,000 from each of the defendants, including Virginia and Gabi. According to the editorialist, photos of the announcements made by the influencers were attached to the trial.
Gabi’s defense claims that the influencer assumed that consumers had been harmed, but that she, too, was hurt. She claims there was a breach of contract with the accessories brand, but that the company continued to use her image inappropriately and did not pay her the promised sum for the publications.
The Virginia woman recalled that she released a statement on social media about the brand saying she no longer had any ties to the company to prevent fans from being harmed.
Both emphasize that they are not required to compensate the consumer, as they were only hired to advertise and had no responsibility for the sale of the glasses.
What the consumer denies, according to her she only made the purchase because she trusted the influencers. She also pointed out that the two somehow profit from advertising and that they are actually responsible for what they publish online.
