According to Daniel Toledo, an international law attorney, founder of Toledo e Associados and partner of LeeToledo PLLC, an international law firm with offices in Brazil and the United States, the visa is owned by the issuing country, not the passenger in question.

“It belongs to the state. I even know the case of a Brazilian woman who had her visa canceled by an immigration officer when she entered the US and she was extremely embarrassed and she didn’t understand the situation. However, if that authority sees something suspicious or that prevents someone from entering the country, it has every right to invalidate a visa, even stamped in a Brazilian passport,” she points out.

The international law specialist says the visa can be revoked at any time, but there are limits.

“Because it is owned by the United States, the immigration officer can scratch or even tear the visa. However, this does not apply to your passport, which must remain intact as it is Brazilian owned. This kind of situation, like tearing up a visa page, would be a clear abuse of authority. But I, in particular, have never witnessed this kind of situation. Normally they write ‘canceled’ and deport the traveler in question,” he declares.

According to the lawyer, it is common that there is a doubt about the legality of this type of procedure.

“Although it seems rude when we go through this kind of situation, there is no room for any complaint or lawsuit against these agents because they are carrying out their surveillance work precisely with the aim of protecting national security,” he concludes.
