unanimously, the Sixth College of the Superior Court of Justice (STJ)) authorized the cultivation of marijuana for medical use in two cases submitted to the court and adjudicated on Tuesday (14). With the decision, 3 people will be able to grow cannabis to extract the cannabidiol oil for medicinal purposes.
Ministers analyzed the resources of patients and family members who have a prescription for the use of cannabis products – widely used in the treatment of diseases such as epilepsy and post-traumatic stress, for example – and who have requested prior authorization for sowing so as not to run the risk of being punished by the drug law.
The decision applies only to the cases analyzed, but should facilitate artisanal cannabis cultivation when there is a prescription and can direct similar judgments in lower courts.
In Brazil, there is still no regulation on home planting of medical marijuana. The import of some cannabis-derived products for health care is already authorized by the National Health Surveillance Agency (ANVISA).
