The STF suspends the sentencing of scientists who debunked fake news about diabetes

The previous decision had established a fine of R$1,000 for moral damages and the removal of extracts of content in which the biologist Ana Bonassa and the pharmacist Laura Marise de Freitas denied the incorrect information.

In case of non-compliance with the order, the channel managers I’ve never seen a scientist they would have to pay a daily fine of more than R$100, with the total capped at R$1,000. In this sense, Judge Larissa Boni Valieris, of the 1st Court of the Special Civil Court, interpreted that they caused a situation of “shame and sadness” for the nutritionist.

Now, Toffoli has suspended the removal of the videos from broadcast and any compensation: “For all of the above, I accept the injunction request to suspend the effects of the censored decision, as well as the enforceability of any sanctions imposed for non-compliance” , he wrote in the decision.

To respond to the scientists’ request to defend themselves, the minister understood that the nutritionist’s misinformation had been transmitted with the intention of marketing a product.

“In the video in question, attached to the documents, there is critical thinking regarding public profile actions and theories based on both facts and scientific data on diabetes, as well as a vehement statement according to which “diabetes is not caused by worms” and that this misinformation is being used to sell a product called “deworming protocol” and, therefore, must be reported.”

Through social media, Bonassa and Marise celebrated the decision, but reiterated that the process is not over yet: “The journey is not over yet, we still have steps to take before the process is completed, but this victory is a milestone for the freedom of scientific diffusion and for all those who find themselves facing similar processes. We are here to make noise in defense of our profession, not only for ourselves, but for all those trying to fight misinformation. We will not remain silent.”
