CFM and Amb will go to court to block the measure, foreseen within 30 days
The Federal Council of Pharmacy (CFF) this week published, in the Federal Official Gazette, a resolution to allow pharmacists to prescribe drugs, including those of sale under prescribed prescription; Perform physical and mental examination for monitoring and health monitoring; and request, perform and interpret laboratory tests. The medical entities argue that the decision is illegal and will adopt all the appropriate measures to block the resolution, which should have effect within 30 days.
According to the CFF, the Resolution no. 5/2025 (Read the full document here) Look for a stretch of Law no. 13.021/2014which provides for the exercise and supervision of pharmaceutical activities. This law states that it is the obligation of the pharmacist, among other activities, “follow the pharmacotherapy monitoring of patients” and “establish the pharmacotherapy profile in the patient’s systematic monitoring, through the elaboration, fill and interpretation of pharmacotherapy files”, without detailing these activities.
In resolution, the Council defines that, to establish the patient’s pharmacotherapy profile, the pharmacist will be authorized to prescribe drugs, including those of sale under prescription; renew the revenues issued by other health professionals; and prescribe drugs by the person at risk of imminent death. In the case of drugs classified as “under prescription”, pharmacists must have a specialized qualification record (RQE) in clinical pharmacy.
“In therapy, it depends on the pharmacist: a) prescribe, add, replace, interrupt and administer drugs in different pharmaceutical forms and administration paths, dietary supplements and medicinal plants,” says the document.
Also according to the standard, the patient’s pharmacotherapy documentation can be composed of the collection of data through pharmaceutical anamnesis (including the patient’s profile, clinical history, pharmacotherapy, family and social); Physical examination with the verification of signs and symptoms; and realization, request, interpretation or verification of exams to evaluate the effectiveness of patient treatment and safety.
‘Attack on legality and security’
The publication of the CFF was followed by strong opposite events of the medical entities, including the Federal Council of Medicine (CFM) and the Brazilian Medical Association (Amb).

For the CFM, the prescription requires an investigation, the diagnosis and definition of the treatment, the exclusive powers of doctors and there is no competence in the law that authorizes pharmacists to prescribe pharmacists of any kind. “This is a clear invasion of medical attributions”, criticism.
Amb also argues that these activities adapt to doctors and that, in line with the CFM, it will take the necessary measures to “guarantee safety in the prescription of medicines to the population”.
The CFM states that “will adopt all legal, legal and policy measures to block this dreamy and consider the leaders of the CFF responsible for any damage to patients deriving from this illegal rule”.
