The public civil action was presented by the Consumer Protection Commission of the Rio Legislative Assembly (Alerj), which indicated the induction of consumer error. The product advertising promised “complete protection for 12 hours even after eating or drinking”.
According to the judges, the advertising message led to the interpretation that brushing after meals would not be requested. The Collegiate considered the offense and determined compensation.
The process unanimously changed the decision of the first instance, which had rejected the action regarding the refusal.
