The lawyer warns that there is no specific visa for tourism at birth and that mothers can prevent you from entering the country
Summary
Brazilian pregnancy women trying to have children in the United States can be prohibited, as there is no specific visa for tourism at birth and the US authorities have intensified the inspection to prevent irregular use of the public health system.
The strategy adopted by several Brazilian celebrities such as Karina Bacchi, Ludmilla, Claudia Leite, Simone Mendes, Andressa Ferreira, wife of deputy thammy Miranda who has chosen to have children in the United States could have their days. According to the lawyer Daniel Toledo, expert in international law and founder of Toledo and the members, the United States government intensified the inspection of pregnant women who try to enter the country with the tourist visa, a practice known as tourism at birth.
“In fact, there is no specific visa for tourism at birth. What these people use is the normal tourist visa, but does not adapt to the category of medical or childbirth surgery. There is an absence in the law for this type of situation, and this has been used by the authorities to prevent women in pregnancy from coming to light in the United States”, says Toledo.
The lawyer explains that the main concern of the United States government is in the use of the public health system by foreigners who travel exclusively to have the child.
“The vast majority of these people are not provided with a paid doctor and all organized. They come to simply have their child, use the public service and still guarantee the right to American support. This is what you try to avoid,” he observes.
According to the expert, the identification of this type of case is not always simple, but immigration agents have prohibited women in more advanced phases of gestation.
“With four or five months, pregnancy is often not visible. But when they arrive in a more advanced state, it is easy to identify. If the consular agent understands that the intention must actually remain for childbirth, it can immediately deny the entrance,” he explains.
To avoid problems, Toledo recommends that pregnant women say the truth by entering the country and the current documentation which shows that all medical expenses are already paid.
“There is no legal provision that allows this type of entry. What can happen is that the traveler openly declares that he intends to have his son in the United States and the agent, if he understands that it is practicable and that all costs are covered, authorizes. But this is very difficult, because emergencies can require a greater stay than the six months allowed”, he says.
The lawyer underlines that, if the stay exceeds the legal deadline, there is the risk of visa cancellation. “If the person says it will be six months and will remain beyond that period, he will lose his visa. There is no room for a way,” he concludes.
It inspires the transformation into the world of work, business, society. It is the creation of the compass, content and the connection agency.
