Since 1988, after the creation of the Brazilian Constitution, women are guaranteed job stability, from confirmation of pregnancy until five months after giving birth, and the woman cannot be fired, even if her contract expires during this period.

Furthermore, the right to maternity leave was regulated in Brazil in 1943, with the creation of the Consolidation of Labor Laws (CLT).



However, as noted by Famivita, in its latest study27% of women are afraid of being fired because they are mothers, i.e. when they return from maternity leave to the workplace.

By age group, the study showed that this fear is greater among women aged between 25 and 29, since 30% of them expressed fear of being fired after returning from maternity leave.

The fear of being fired is great in all states

Data obtained by the state showed that in the Federal District and Espírito Santo, at least 38% of mothers feared being fired. In Sao Paulo and Rio de Janeiro, however, 31% and 27% respectively feared being fired after giving back their licence. As for Santa Catarina and Minas Gerais, the percentage drops to 24% of respondents concerned about being fired in these circumstances.

It is important to underline that, according to the legislation, high-risk pregnant women can go on maternity leave from the 28th day before the expected birth. It’s also worth noting that the 120-day license is good for adoption as well. In these cases, the date starts from the signing of the judicial term for pre-trial detention.



Another point to underline is that even new mothers are entitled to two half-hour breaks a day to breastfeed in the first six months of the baby’s life. Breastfeeding leave is a right that must be ensured by companies, including the guarantee of a space reserved for it.
