The lawyer Marco Antonio Rodrigues dos Santoswho received a pix wrong from Rede Globe in the amount of BRL 318 thousandthe amount was ordered to be returned to the issuer.
According to the sentence, issued on the 23rd by Judge Luiz Felipe Negrao, of the 3rd Civil Court of Barra da Tijuca/Rio de Janeiro, he will have to rescind the amount with monetary correction and interest of 1% for each month spent with the money.
According to the trial, Pix arrived in his account by mistake on December 27, 2021. The error would have occurred because the lawyer had already been a “patron in a union case” against the company.
Three days later, Globo contacted Marcos Antonio to recover the money, but informed that he had already bought a property with the sum he had received.
A few days later, without being able to contact the lawyer, the company decided to open the trial, which only had the sentence defined almost a year later.
“It matters little whether or not the defendant intended to return the sum, or for how long after being consulted by the plaintiff, he did not respond to the messages: what matters for the application of the law is the receipt, without legal cause, of the ‘amount or thing,” says the document.
“The defendant is obliged to repay R$ 318,600.40 with monetary recalculation (art. 884 CC), from the date of the transfer made by the plaintiff (12/27/2021), and statutory default interest of 1% pm, counted dated 01/10/2022, the date on which the author informed him to return the amount”, he concludes.
