Patients must pre-register with the state Department of Health and submit a report and prescription for diseases where the use of the treatment has been shown to be beneficial.
THE Legislative Assembly of São Paulo (Alexei) published this Friday 13 the law that guarantees free access to patients to medicines with cannabidiol fur Single Health System (sus) in the state health network. The text defines that cannabinoid-based medicines must first be registered with the National Health Surveillance Agency (Anvis) and in the country of origin, scientifically proven beneficial effect and will be distributed only on medical report and prescription that justifies the treatment.
The law, approved at the end of December and signed by the governor Tarcisio de Freitas (Republicans), goes into effect in 90 days and sets a one-month period, beginning this Friday, for the state Department of Health to implement all of the guidelines provided.
The record is also responsible for registering all patients: the form must be available online. In it, the person must demonstrate that they do not have the economic conditions to purchase the treatment in the private network.
The drugs will be distributed only to treat diseases for which the use of cannabinoids is indicated in art International classification of diseases and related health problems (cid). Scientific research in recent years has already shown that the substance benefits autistic people, with Parkinson’s, Alzheimer’s, epilepsy and rare diseases, for example.
Also in October, the Federal Council of Medicine (CFM extension) issued a resolution limiting the use and public discussion of cannabinoids in Brazil. The measure prohibited doctors from giving lectures and courses on the use of cannabis-derived products outside the scientific environment.
Less than a week after the resolution was published, the CFM withdrew from the decision after strong opposition from civil society and a questioning by the Federal Prosecutor. The body said it would re-discuss the topic and open a new public consultation on the use of cannabinoids.
Consult the rules for accessing the cannabinoid-based treatments of SUS in São Paulo:
- The patient must pre-register with the State Department of Health, which can be done online, by email, or delivered directly to the record building;
- Registration can be made in the name of the patient or a legal representative;
- Only treatments with the maximum concentration of tetrahydrocannabidiol authorized by Anvisa will be distributed;
- The patient must present a report from a legally qualified professional containing the description of the case, the classification of the disease in the ICD, the justification for using a drug not registered in Brazil with respect to existing therapeutic alternatives and the evolution with respect to previous treatments ;
- The patient must also present a prescription for the drug from a legally licensed professional with the name of the patient and the drug, dosage, amount needed, treatment time, date, signature and membership number of the registered professional in his class council;
- The patient must sign a declaration of responsibility and clarifications for the exceptional use of the medicine
