Ex-President’s Defense Considers Changes in Court May Generate a More Favorable Scenario for Analyzing Action on Ballot Bindings




Former President Jair Bolsonaro’s (PL) lawyers are studying legal alternatives to anticipate the ruling of the action investigating the attacks on electronic voting machines carried out by the former Chief Executive during a meeting with ambassadors at the Palácio da Alvorada , in Brasilia, in July last year. The action is pending in the Superior Electoral Tribunal (TSE) and the defense estimates that there will be significant changes in the composition of the Tribunal in the second half of the year that could benefit the former representative. The action proposed by the PDT, in August 2021, is considered by Bolsonaro’s entourage as the process with the highest risk of making him ineligible. In it, the former president is accused of abuse of political power and misuse of the media.

In recent trials, the TSE has inflicted defeats on Bolsonaro, but with a narrow score – usually 4 votes against 3. In this way, the changes foreseen for the next few months are seen as decisive in reversing the unfavorable results for the former president .

The first change will take place in April after the minister Ricardo Lewandowski, one of the judges most aligned with President Lula, retires on his 75th birthday. the minister Nunes Marquessesnominated by Bolsonaro to the Federal Supreme Court (STF), he will be his replacement.

Another major exchange is expected in May. It is during this period that the tenure of Sergio Bagni, TSE member of the lawyers’ contingent. According to the practice of the Court, the vacancy must be filled by the minister Maria Claudia Bucchianeri. Bucchianeri is regarded by the legal community and his peers as a neutral judge. Since 2022, the minister has delivered decisions that have displeased both the Workers’ Party (PT) and Lula.

In November, the Court will also undergo another delicate exchange: Benedito Goncalves will resign from the post of Inspector General, the post responsible for carrying out actions related to election investigations. Gonçalves, who is a member of the Superior Court of Justice (STJ), has made decisions contrary to Bolsonaro’s interests. He will be replaced by Raul Araujo, another member of the STJ. During the 2022 campaign, Araújo responded to a request from the PL and ordered the removal of videos in which Lula calls Bolsonaro “genocidal”, a decision reversed in the plenary.

In all, 16 actions are pending in the court against Bolsonaro. The former president is being investigated for spreading fake news, abuse of political power and improper use of the media.
