The NGO denounces the dismantling of the prevention mechanisms of this type of violence in the country during the Bolsonaro government and criticizes the low budget dedicated to these entities in the first months of Lula’s new mandate. Tuesday (14/03) for the dismantling of the mechanisms to combat torture in the country during the government of Jair Bolsonaro, and for the low budget of these entities in the first months of the new mandate of Luiz Inácio Lula da Silva.
The complaint forwarded by the NGO Conectas Human Rights cites the policies adopted by the Bolsonaro government that have led to the dismantling and emptying of bodies to combat this type of violence, such as the National Mechanism for the Prevention and Combating of Torture (MNPCT), which had their budgets reduced to paltry levels.
In his government, Bolsonaro has even exonerated the 11 experts who were part of the MNPCT and made visits to prisons to prevent inhumane practices against detainees. Later, the changes in the body would eventually be overturned by the Federal Supreme Court (STF).
The document also specifies that the funds allocated to the MNPCT in the first months of the Lula government have been kept below what is necessary, according to the budget law adopted by the previous government.
“Even with the new government, the National System for the Prevention and Combating of Torture in Brazil remains weakened, with a paltry budget,” reads the complaint.
Conectas also asked the Human Rights Council to question the Brazilian government on the implementation of in-person custody hearings, to ensure that police do not torture prisoners.
The NGO also defends vigilance over therapeutic communities that treat drug addicts, “taking into account international parameters of treatment and social protection”.
Violations of prisoners’ rights
The complaint was presented to the Special Rapporteurship on torture and other cruel, inhuman or degrading treatment or punishment of the United Nations, represented by the rapporteur, the Australian Alice Jill Edwards.
“We ask the Special Rapporteur to question Brazil on its obligations to prevent and combat torture and we urge the Special Rapporteur with his colleagues to heed the urgent appeal sent by Brazilian organizations on the tragic situation of vexatious searches, which violate the rights of people deprived of their liberty and their families”, says the NGO.
The NGOs Conectas Human Rights and Global Justice had already denounced the dismantling of the system of combating torture in Brazil on March 11, during a session of the UN Council for Human Rights in Geneva.
On the occasion, the entities highlighted the systematic attacks by the Brazilian government on the National System for the Prevention of Torture and the Bolsonaro decree which exonerated and extinguished the positions of all the MNPCT experts.
