the defense of Robinho has taken the umpteenth initiative on the case of the player, convicted in Italy of the crime of sexual assault. The attacker’s lawyers have petitioned the Superior Court of Justice (STJ) to order the body to order the Italian government to send the trial translated into Portuguese and a complete copy of the document to Brazil.




Recently, the STJ responded to the request of the Italian Justice for the athlete to respond to the case in Brazil. Robinho fled the country before the authorities could convict him of the outcome of the trial. He is in Brazil and cannot be extradited as the Federal Constitution and the Immigration Law prohibit certain actions for a native Brazilian.

The player’s defense request was attached to the trial already underway at the STJ last Thursday. The petition will be analyzed by the President of the Supreme Court, Minister Maria Thereza de Assis Moura.

In formulating the request, the athlete’s defense reiterated that, in order to be able to defend the client, it is necessary to have the translated process of the case in hand. In addition, the athlete’s representatives said the Italian government’s request “lacks due diligence”. As stated in the appeal, the copy of the original of the trial and the translation were not sent, “making it impossible to exercise the right of full defence”.

The lawyers also argued that the crime of rape was committed by a group of people linked to Robinho. The accusation, however, falls only on the player and on another person (Ricardo Falco, a friend of the attacker). The former player of the Brazilian national team denies the crime and his representatives affirm that the Italian justice preferred the victim’s version.

– These circumstances demonstrate that full knowledge of the process from which the conviction arose is necessary so that the legal presuppositions (suspects) of the possibility of applying for approval are verified (process that discusses the fulfillment of the sentence in Brazil) – says part of the petition.

Robinho was finally sentenced by the Italian court to serve nine years in prison for the crime of sexual assault last year. The STJ has decided to accept the request of the Italian Justice for the attacker to serve a prison sentence in Brazil in the last month. The announcement of the action was made by Flávio Dino, Minister of Justice and Public Security, through social networks.
