The Novo party has asked the Federal Supreme Court (STF) to reconsider Minister Ricardo Lewandowski’s decision which paved the way for the appointment of politicians to state-owned companies.
Lewandowski’s decision was made on Thursday at the request of the PCdoB and nullified parts of the state law that barred the appointment to executive positions of people who held public office or had acted in political parties or election campaigns in the past three years. . The provision is provisional and will be judged by the plenary assembly.
The action challenging the provisions of the state companies law had entered the STF agenda on 10 March, but the process was halted the next day due to a request for review (more time for the analysis) by Minister André Mendonça. Subsequently, the PCdoB sought an injunction (on an urgent basis) to secure the appointment of politicians for SOEs before the deadline for electing SOE directors and board members, which expires in April.
Novo argued that Lewandowski’s injunction violates the principle of collegiality, according to which decisions are taken jointly by the Court. “The exercise of this legitimate and sound right (request for reexamination), as a magistrate, by His Excellency Minister André Mendonça, however, does not seem to have satisfied some political interests that are not yet very clear to this applicant”, stated Novo in the petition.
Hours after Lewandowski’s injunction, Mendonça reacted and returned the documents for judgment. It is uncommon for this return, which must be made within 90 days, to happen so quickly. Now it’s up to the President of the Tribunal, Rosa Weber, to lead the action.
The matter concerns the government of Luiz Inácio Lula da Silva, which was waiting for the easing of the rules to appoint, for example, the former governor of Pernambuco Paulo Câmara (ex PSB) president of the Banco do Nordeste (BNB) .
