TSE requests access to the expertise of the “draft of the coup” in action against Bolsonaro

The Corregidor General of Electoral Justice, Minister Benedito Gonçalves, asked the Supreme Federal Court (STF) for access to the expert opinion carried out in the document known as the “draft of the coup” for inclusion in one of the cases pending before the Electoral Superior Tribunal (TSE) which can lead to the ineligibility of former president Jair Bolsonaro.

The text of the document, found during a federal police search and seizure operation at the home of Anderson Torres, Bolsonaro’s former justice minister, was intended to establish the conditions for reversing the current president’s electoral victory Luiz Inácio Lula da Silva establishing a state of defense at the headquarters of the TSE, indicating that there may be a coup.

Gonçalves is the rapporteur of the action to the TSE presented by the PDT calling for the investigation into the alleged practice of abuse of political power and abuse of the media, in addition to abuse of purpose, due to a meeting in July 2022 at the Palácio da Alvorada do then president with ambassadors from several countries, in which the then re-election candidate attacked, without evidence, the integrity of the electoral process, voting and electronic ballot boxes. Subsequently, the project was included in the action.

In the provision, the inspector general requests “provided that the investigations are preserved in the second trial, information on the outcome of the expert reports carried out in the ‘draft decree on the State of Defense’ and the sending of a copy of the terms of the testimony given by Anderson Gustavo Torres”.

Among the information requested by Gonçalves from STF minister Alexandre de Moraes, there are also copies of the terms of Torres’s testimony in the context of the action on the January 8 anti-democratic acts that led to the looting of the buildings of the Planalto Palace, the National and STF Congress.

Torres already testified to the TSE last Thursday in the action reported by Gonçalves.
