Bill introduced by Bolsonaro in September 2021 proposing to change the civil rights framework for the Internet and limited platform moderation
President Luiz Inácio Lula da Silva presented a proposal to the National Congress to remove the bill 3227/2021, drafted by former president Jair Bolsonaro, from the pipeline.
The request was published in this Friday’s (06.Apr.2023) edition of the Official Gazette.
CONTENT. The project, presented in September 2021, proposes an amendment to the Marco Civil from the Internet and reports the exact text of an interim measure presented by Bolsonaro, subject to widespread criticism by civil society and specialists.
Since the deputy did not advance, having been returned to the Executive by the president of the Senate, Rodrigo Pacheco, Bolsonaro tried to send the text through a bill.
“JUST BECAUSE”. The text sent by Bolsonaro has the potential to reduce the autonomy of platforms to carry out self-moderation and includes a list of “just causes” that limit the performance of platforms in these situations, providing penalties for situations excluded from the list .
ANSWER. At the time there was a large mobilization of civil society and opposition parties to stop the text. In addition to the problematic content, the attempt to pass this amendment through a provisional provision represented an authoritarian and opaque decision by Bolsonaro.
