Judge Eduardo Appio, of the 13th Federal Criminal Court in Curitiba, urged impeached Congressman Deltan Dallagnol to testify, as a witness, in a proceeding involving attorney Rodrigo Tacla Duran – former financial operator Odebrecht who now accuses the former head of the task force of the operation in Paraná and Senator Sérgio Moro, a former judge.
Disappointed with the architects of Lava Jato, Appio wants to hear Deltan about his relationship with the lawyer Walter José Mathias Junior, who is handling the cases involving Tacla Duran. The lawyer filed an objection of suspicion against Walter on the basis that, in a hearing, the prosecutor “acknowledged personal ties” with the former head of Lava Jato.
The hearing has been set for June 19 at 4.30pm. According to the order, Deltan should face Appio.
The judge noted that the hearing will be in-person as Deltan “no longer has the prerogative of forum or legal privileges inherent in a federal deputy’s mandate” – the former Lava Jato boss had his mandate revoked by the Superior Electoral Court Tuesday 16th.
The suspicious action against Walter was filed on April 11 in the Paraná Tribunal. A week later, Appio issued a first trial order: he urged Walter to comment on Tacla Duran’s allegations, also emphasizing the urgency of the case, given that the former Odebrecht operator now has protected witness status.
According to Appio, the evidence produced so far in the lawsuit that supports Walter’s impartiality should be supplemented by the Deltan hearing, so that the accused deputy “clarifies whether he maintains a personal and intimate bond of friendship” with Walter José Mathias Junior.
Seven years after being arrested in the wake of Lava Jato, then-Judge Sérgio Moro, Tacla Duran has once again been a linchpin in the operation, now due to allegations against his former bosses.
After having the quote revoked, the lawyer testified before Judge Eduardo Appio and said he was the victim of extortion in exchange for facilitating clients in collaboration agreements with the extinct Lava Jato task force. “The authorities who followed the trial thought I was betting on the statute of limitations strategy, that I didn’t want to defend myself, no, it’s never been like this, never. I was just hoping to have a transparent judgment,” he said at the hearing.
The hearing was held at the request of the defendant, in the midst of a trial in which he is accused of money laundering. The process is suspended by order of the STF.
Both Moro and Deltan deny the allegations made by the lawyer targeted by Lava Jato. The impeached MP says the complaint is “fantastic”. The senator, on the other hand, speaks of ‘the political use of slander made by a self-confessed offender without credibility’.
The allegations were forwarded to the Supreme Court, through the prerogative of the forum of Senator Sérgio Moro. On the eve of his retirement, Judge Ricardo Lewandowski granted the Attorney General’s Office request and reaffirmed the Supreme Court’s jurisdiction to hear the allegations – contrary to the interests of Moro and Deltan.
