TJMG judges apply maximum sentence to magistrate accused of lack of decorum in crimes against lawyers, STF and CNJ
The documents to which the column had access show that 20 judges of the special body of the Court of Justice of Minas Gerais (TJMG) voted in favor of the mandatory retirement of the Bolsonarista judge Ludmila Grilo.
Five other judges were defeated in court, as they defended the imposition of an intermediate sanction, censorship, which would prevent any promotion on merit for a year.
Ludmila was head of the Unaí Criminal and Child and Youth Court (MG), but had been removed from her duties by the National Council of Justice (CNJ) since mid-February. She responds to two other disciplinary processes at the CNJ. At the TJMG she had already received two warnings in disciplinary proceedings.
In this new disciplinary process at the TJMG, which led to her forced retirement, Ludmila was faced with four charges: having offended the CNJ with memes on social networks, not respecting decency by attacking lawyers and followers of the Instagram profile @papodecriminalista, having made vulgar statements about custody hearings on Twitter and attacking the Federal Supreme Court (STF) in a lecture promoted by the Bolsonaro government at the Farnesina.
In the session of the Special Corps of the TJMG last Wednesday, 24, the rapporteur of the case, Judge Valdez Leite Machado, had defended the punishment of Ludmila with the penalty of censure, but was only accompanied in this position by four other judges.
The vote of the TJMG magistrate, Luiz Carlos de Azevedo Corrêa Junior, won by defending Ludmila’s mandatory retirement with an income proportional to her contribution time, the highest penalty foreseen for magistrates in disciplinary proceedings.
In his vote for the mandatory retirement of the judge, Corrêa Junior was accompanied by the president of the TJMG, José Arthur Filho, and 18 other judges.
In short, the judges understood that the judge violated the Organic Law of the Judiciary and the Code of Ethics for Judges by lacking the decorum, integrity and dignity necessary to function in these attacks and offenses against attorneys, CNJ and STF.
“In nature, the actions imputed to the defendant go head-on against those obligations, bringing discredit to the image of the entire Judiciary and, in particular, of this Court,” Judge José Arthur Filho said in a vote for forced retirement .
One of the toughest votes against the judge came from Judge Renato Dresch.
“The magistrate, tried here, lacked not only the vocation for the judiciary, but the good nature, the rectitude, indispensable for the exercise of the judiciary,” said the judge in a vote for forced retirement.
In a statement in the disciplinary process, Ludmila said that “there is censorship” in the judiciary and “that this administrative process is proof of that”.
