Procon will fine Netflix BRL 500 for each complaint received in SC

Body says the streaming platform ignored requests for clarification on the extra costs per screen

The consumer protection agency of Santa Catarina, Procon-SC, has decided to open an administrative proceeding with a precautionary measure against Netflix for Breach of contract. The ruling came after the streaming platform failed to respond to the agency’s requests for clarification following a controversial change to the service’s subscription policies.

Netflix announced, at the end of May, that it will charge the additional amount of BRL 12.90 per month of users accessing the platform outside their primary residence, at each new address. The measure, according to the streaming giant, aims to curb the sharing of passwords.

The decision had already been announced in February, through a statement canceled after the negative repercussions. Trials of this new system have already begun in Chile, Costa Rica and Peru.

Since then, consumer protection bodies have sought more information on the extra cost to take a stand on the complaints of thousands of consumers across Brazil. In Santa Catarina, Procon-SC even notified the streaming giant for more information, to no avail.

This Tuesday 6 the agency opened an administrative proceeding with a precautionary measure against Netflix. For each new complaint registered against the platform since the additional charge notification, a fine of BRL 500 will be applied.
