The President of the Chamber of Deputies, Arthur Lira (PP-AL), put it on the agenda at the last minute, on the night of this Wednesday 14, with the support of the government Luiz Inácio Lula da Silvaa bill by the deputy Daniel Cunha (União Brasil-RJ), daughter of the former deputy Eduardo Cunha, which makes discrimination against politicians a crime. The provision benefits, for example, targets of Lava Jato and relatives and advisers of politicians under investigation. The proposal was approved unanimously.

Among the behaviors deemed discriminatory are the refusal to open or maintain a bank account or to deny any loan to so-called politically exposed persons (PEPs), a category which also includes the authorities who command military bodies, the judiciary and parties, as well as elected officials and relatives. The project had the support of 252 deputies and 163 against.

Lira’s trusted man, the rapporteur Claudio Cajado (PP-BA) only presented the final report, with the replacement text, after the proposal was put to the vote at around 20:30. The mayor managed to approve the urgent request in less than 30 minutes, with 318 votes in favor and 118 against. Immediately afterwards, the project was put to a vote on the merits of the issue, also under the protest of MPs from PSOL and Novo, accompanied by a few dissidents from other groups.

Cajado’s text withdrew the proposals also criticized by former president Jair Bolsonaro’s PL deputies, such as the article that increased the penalty for the crime of insulting when committed against politicians – which was seen as an act in the very cause of Danielle, since her father was under investigation for corruption offences. Lira was close to Cunha, who commanded the Centrão, and was replaced by the deputy of Alagoas in command of the block.

The parliamentarians asked Lira to postpone the vote, due to the delay in delivering the minutes, but he denied the question of order, as the regiment allowed the analysis straight away, even without the text deposited in the system.

According to the text of the substitute put to the vote, any refusal to open a bank account or a loan for politicians becomes a crime, with a penalty of 2 to 4 years in prison. The prohibition of access by the public administration, directly or indirectly, to politically exposed persons also constitutes a crime, with the same penalty, unless there is a prohibition imposed by law.

“This project grants privileges and makes investigations difficult. It creates a kind of protection for cracking oranges. This project is in the interest of legislation for its own sake. This will only offend us more at airports and for this we have Is there already legislation or don’t you know that there are already crimes of slander, defamation and defamation?” said Congressman Chico Alencar (PSOL-RJ).

Without mentioning a specific case, supporters of the proposal have said in speeches that even their grandchildren have already been denied bank accounts, simply because they are relatives of politicians.

“It is unacceptable for a relative of ours to have his account suspended simply because he is the son or relative of a politician. This is not a privilege,” said MP Elmar Nascimento (União-BA), leader of the party and quoted to succeed Lira as president of the House.

Eduardo Cunha, father of the author of the proposal, has already had all his bank assets blocked by the Justice, as part of the investigations and convictions obtained by Operation Lava Jato.

“Any embezzler or defendant convicted in the second instance is guaranteed the opening of a bank account, including the granting of credit,” criticized MP Marcel Van Hatten (Novo-SP).
