Jair Bolsonaro Ineligible: What Could Happen Now

The former president has been out of elections for 8 years; see remedies in case of conviction

The Superior Electoral Court (TSE) has learned that former President Jair Bolsonaro (PL) committed abuse of power and misuse of the media due to his participation in a meeting with foreign ambassadors, in which he made groundless allegations against the system electoral.

With the decision, the former president is not admissible AND he cannot participate in elections for a period of eight years. There are, however, some resources that Bolsonaro’s defense can use.

What happens now with Bolsonaro?

With the sentence, Jair Bolsonaro will not be able to participate in the municipal elections of 2024as well as the 2026 state and national elections.

It is important to clarify that this action underway at the TSE is not of a criminal nature, therefore, even if convicted, Bolsonaro will not be arrested as a result of this decision.

Can Bolsonaro file an appeal?

Jair Bolsonaro will have the opportunity to appeal both to the TSE itself and to the Federal Supreme Court (STF). The former president’s defense has already expressed this intention.

There are two resource options:

• Embargo statements: This resource would be directed to the TSE. In it, the defense would highlight obscurity and contradictions in the decision, seeking to overturn any ineligibility and setting the stage for a subsequent appeal to the STF.
• Amazing Feature: This appeal will be sent to the STF. In it, the defense should argue that any decision of ineligibility of the TSE violated constitutional principles. Bolsonaro’s lawyer, Tarcísio Vieira, indicated that he had already identified the elements for this appeal, based on the restriction of the right of defence.

Both appeals have a three-day deadline for filing. However, if the request for clarification is presented earlier, the deadline for the extraordinary appeal will not be counted.
