Alessandro Lo-Bianco will respond to Patricia Poeta’s lawsuit in criminal matters

Alessandro Lo-Bianco, journalist of RedeTV!, will respond in criminal matters to the lawsuit brought by Patricia Poeta, presenter of Globo. The decision was made by Judge Ana Claudia dos Santos Sillas, of the 26th Criminal Court of São Paulo. Patricia Poeta accuses Lo-Bianco of defamation, in a lawsuit filed in the first half of this year.

According to the magistrate’s decision, Poeta’s criminal complaint meets the requirements of Article 41 of the Criminal Procedure Code. The judge said that there is evidence of the materiality of the offense and sufficient evidence of criminal paternity. Thus the lawsuit against Alessandro Lo-Bianco was accepted.

Currently, the penal code provides for imprisonment from three months to one year and a fine for the crime of defamation, i.e. “defamation of someone by attributing to him an act harmful to his reputation”. Whoever, knowing that the accusation is false, “disseminates or divulges it” incurs the same penalty.

No agreement between the parties

The decision was made after the parties failed to reach an agreement. The team of lawyers of the presenter of “Encontro” would have asked for a public apology from the columnist of “A Tarde é di lei”, but the proposal was rejected. Lo-Bianco’s team said they did not agree with the censorship and believed in the judiciary’s decision.

Even during the trial, Patricia Poeta said she continued to be attacked by Lo-Bianco. According to the presenter, the journalist continued to persecute and harass her, inventing non-existent facts or commenting on posts she made on third-party pages. Poeta claims that Lo-Bianco acts in this way to increase the audience of the television program in which she participates.

Lo-Bianco retorted Patricia Poeta on a social network, stating that what she has been experiencing for 12 months is a rejection and that she has chosen the wrong professional to try to keep quiet. The Globo host also cited other lawsuits and a conviction for Lo-Bianco, including a conviction for “discriminatory injuries” and charges of assault, false imprisonment and domestic violence by an ex.

Lo-Bianco’s team took an official position, stating that the journalist was the victim of a strategy aimed at questioning his personal life to discredit his image. The team believes that Lo-Bianco’s professional life does not discredit him in any way within the process.
