PL setting national streaming quota may be voted on soon

The Chamber of Deputies this week approved the emergency regime of a PL (bill) which provides for quotas of national content on on-demand audiovisual content platforms, commercially known as “video on demand” or VoD, such as Netflix , Hulu, Vimeo and Now, as reported by Chamber News Agency.

Also, the PL 8889/17drawn up by deputy Paulo Teixeira (PT-SP) – on leave because he took over from the Ministry of Agricultural Development – ​​provides for the payment of the Condecine (Contribution for the development of the national film industry) by these companies.

The proposal could be voted on in the next plenary sessions and will have Deputy André Figueiredo (PDT-CE) as rapporteur.

This is because, with the approval of the urgency, the project will be analyzed by the plenary assembly of the Chamber without going through a special commission, as foreseen by the procedure.

PL of national streaming fee

As stated in the text of the project, up to 20% of the total hours of the catalog of audiovisual productions offered by the platforms must be titles by Brazilian producers. This percentage depends on the company’s gross revenue.

As far as transfers are concerned, the text establishes that they start at 0% (for companies with annual gross revenues of up to R$ 3.6 million) and establishes a limit of 4% (for platforms with annual gross revenues of more than 70 million of R$).

“Balanced Conditions”

The deputy wants the service of platforms such as Netflix and Now, which is growing rapidly in Brazil, to be offered “on balanced terms” with those of pay-TV companies.

The Conditional Access Service Act (12.485/11) already provides for quotas of national content on pay-television channels and packages and provides for the payment of Condecine by these companies.

According to the text, the rules will apply to all platforms that offer services to users residing in Brazil, “regardless of the location of their headquarters”.

Micro and small businesses opting for Simples Nacional will be excluded from the obligations.
