Cristiano Zanin is the next minister to vote

BRASÍLIA, 14 SEPTEMBER – The Federal Supreme Court (STF) resumes today, with the vote of Minister Cristiano Zanin, former lawyer of President Luiz Inácio Lula da Silva, the trial against the first four defendants for the January 8 coup.

The rapporteur of the case, Minister Alexandre de Moraes, voted on Wednesday (13) in favor of sentencing the first defendant, Aécio Costa Pereira, aged 51. The defendant is imprisoned in Brasilia and is accused of having invaded and vandalized the National Congress together with other Bolsonarists who advocated the establishment of a military government to overthrow Lula.

“The flat earthquake and the dark denialism of some people make it seem like, on January 8th, we spent a Sunday in the park. People came, they lined up and ‘now we’re going to invade the Supreme Court, we’re going to break a little thing ‘Pray on the presidency of the Senate,'” Moraes said, defending his vote.

The magistrate proposed to sentence Costa Pereira to 17 years in prison for crimes such as coup d’état, criminal association, violent abolition of the democratic rule of law and qualified damage “There is no freedom of expression to attack democracy, request of the institutional act number five, the return of torture, the death of political enemies, of communists, military intervention. This is a crime,” he added.

In his vote, Moraes also presented the concept of multiple crimes, committed by a group and without the need to describe the individual participation of each defendant: “The criminal mob destroyed property.”

Minister Kassio Nunes Marques, appointed to the STF by Jair Bolsonaro, opened a disagreement and voted to sentence the defendant to two and a half years in prison, only for qualified damage and deterioration of public property.

For Nunes Marques there are insufficient elements to qualify the accused for the other crimes. .
