Robinho’s defense lawyers have appealed to the Superior Court of Justice (STJ) challenging the former player’s fulfillment of his sentence in Brazil. The Italian court sentenced the former Santos striker to nine years in prison for a rape case that occurred in that country in 2013. But it asked the former athlete to serve the sentence in Brazil, where he is currently located.
According to a document sent by Robinho’s defense, the Italian court’s recommendation violates Brazil’s sovereignty and its Constitution. The defense also attests that it relied on the Immigration Act, which came into force in 2017, four years after the crime. Minister Francisco Falcão, rapporteur on the case, gave the Italian embassy in Brazil five days to respond.
Under Brazilian law, Robinho cannot be extradited to serve his sentence in Italy. However, even though he was free, he had to surrender his passport and could not leave the country. In August the former Santos player’s defense asked the Italian court to send a copy of the case in Portuguese, but the STJ rejected the request.
The case involving Robinho occurred on January 22, 2013. He and five friends were at a party house in Milan, northern Italy. According to the investigations and trial in Italy, the six raped a young Albanian girl, then 22 years old. Robinho and his friend Ricardo Falco were convicted of the crime at first instance, six years ago.
