Congress approves a change in case of loss of Brazilian nationality


Citizens will lose their original citizenship only if they express this wish in writing, with the possibility of reacquisition.

OR National Congress promulgated this Tuesday (3) constitutional amendments 130 and 131. Constitutional amendment, 131, modifies the Constitution on the loss of Brazilian nationality. With the change, the citizen will not lose his Brazilian nationality if he acquires another citizenship.

Today the Constitution provides for the extinction of Brazilian nationality when the citizen possesses another nationality, except in two situations: when the law of the other country recognizes the original nationality or imposes naturalization as a condition for remaining in the country.

With the change, citizens will lose their original citizenship only if they express this wish in writing, with the possibility of reacquisition.

“The change is healthy considering that the original nationality must be preserved as much as possible, as it derives from the factor linked to the birth of the person. The formation of a family and a career abroad, the main causes of renunciation of nationality, do not necessarily imply the distance from Brazilian origins”said the president of the National Congress, Senator Rodrigo Pacheco (PSD-MG)in the solemn session of promulgation.

According to the deputy Bia Kicis (PL-DF)who reported the fact Roomthe measure should directly benefit 2.5 million Brazilians and approximately 4 million Brazilians living outside the country.

The amendment to the Constitution provides that citizens can regain Brazilian nationality, which still requires specific legislation.

Exchange between judges

Amendment 130 authorizes the exchange between state judges of different courts. Pacheco stressed that changing the Constitution will correct the asymmetry in the judicial system, as this possibility has been granted to federal and labor judges for more than a decade.

“Asymmetry refers to the right of movement by exchange between courts of different units of the Federation of members of the judiciary. (…) unjustifiably unequal treatment between judges linked to courts of justice – prohibition to exercise this right due to lack of support regulatory”Pacheco said.

The exchange was suggested by the Brazilian Association of Magistrates. Currently, state judges can change districts, but must pass a public exam if they go to another state.
