There is a constant attempt to amend the Quota Law (n° 8,213/1991) and weaken its effectiveness through alternatives to hiring workers with disabilities, its original objective.

Among the many proposals, the bill (PL) 1231/2015, by the deputy Vicentinho Júnior (PSB-TO), which provides “mechanisms to facilitate the hiring of people with disabilities in the private sector and compensation measures to be adopted, has recently had repercussions when the minimum quota cannot be reached for reasons beyond the control of the employer”.

The Quota Law provides for the regular hiring, pursuant to the CLT (Consolidated Labor Law), from 2% to 5% of people with disabilities in companies with 100 or more employees.

In the original text, for example, PL suggests that “the statistical control will be based on a national database of the CVs of those interested in filling the vacancies reserved for people with disabilities, in which, in addition to the civil identification of the interested party, the the data that allow us to trace your professional profile”.

Another proposed measure is that “the hiring percentages of people with disabilities will be applied to all workers working in the company, excluding jobs subjected to dangerous or unhealthy conditions, in compliance with the regulations” and “to companies that demonstrate who, for reasons beyond the control of the employer, are unable to complete the minimum percentage of vacancies reserved for people with disabilities, they will be exempted from the corresponding sanction, when they adopt one or more of the following compensatory measures” such as scholarships, training courses and donations to organizations.

According to official data, among the 18 million people with disabilities in Brazil, only 486 thousand have formal employment (Pnad, IBGE).

In September, the PL addressed the Chamber’s Works Committee (CTRAB), with the favorable opinion of the rapporteur, the deputy Fernanda Pessoa (UNIÃO/CE), and a decision on five additions and one amendment.

Last week, the ‘Tarantino Coffee ‘n Geek’ bar, which has been operating since 2019 on the ground floor of the Shopping Parque Balneário, in Santos-SP, in the Gonzaga neighborhood, was attacked by a woman against the rainbow-colored flag fixed on the facade of the site since June in support of International LGBT Pride Day, it was recognized as the first business in the State of Sao Paulo to promote inclusion, diversity and respect.

The “LGBTQ Friendly” certificate was issued by the Secretariat of Justice and Citizenship (SJC) and personally delivered to the owner of the facility by two representatives of the department.

Also last week, bill no. 5.167/2019, which provides for the ban on same-sex marriage, was approved by the Social Security, Social Assistance, Childhood, Adolescence and Family Commission of the Chamber of Deputies.
