The Rio Court of Justice (TJRJ) filed a complaint of religious racism against Silvana Taques, mother of Larissa Manoela. She was accused of intolerance towards the family of her daughter’s boyfriend.
The investigation had been ongoing since August, after traces of insults against the family of Larissa’s boyfriend had come to light. Silvana called her son-in-law’s family “macumbeira”.
According to the decision of the 32nd Criminal Court of the Capital District, the behavior of the suspects, calling AndrĂ© Frambach’s family “macumbeira”, “was not directed against a community, but specifically aimed at his son-in-law’s family”. -law”. Since the victims did not want to continue the investigation, the case was closed.
“Even if the conduct of Silvana Taques Santos were considered as a mediated form of prejudicial-religious insult, it would be a public criminal action conditional on the representation of the offended party. In this case, the victims have already explained that they have no interest to continue the investigation, which allows us to conclude that there was a lack of representation,” Judge AndrĂ© Felipe Veras de Oliveira Guedes, of the 32nd Criminal Court of Rio de Janeiro, said in his decision.
The request to dismiss the case had already been made by the Public Prosecutor of Rio (MPRJ), author of the accusation, on 1 December. On this occasion, the MPF expressed itself in a document stating that “there is no evidence that Larissa Manoela is a practitioner of Umbanda. In this sense, the expression ‘macumbeira’ does not even have the character of a religious offense, but rather of discussion between relatives, with wounds and resentments that is the responsibility of an auxiliary psychologist, not of criminal justice”.
The decision of the Court of Rio de Janeiro comes a week after the Civil Police indicted Silvana Taques for religious racism. Her complaint underlined that the message she wrote to the family of her daughter’s boyfriend could be considered a “discriminatory act disguised as contemporary forms of racism”.
Religious controversy
As is known, Larissa Manoela is the daughter of an evangelical father and a Catholic mother, as well as having studied as a child in an Adventist school (recommended by the Seventh-day Adventist Church). Apparently, the actress’s parents were uncomfortable with AndrĂ© Luiz Frambach’s family religion, which follows spiritualism according to the teachings of Allan Kardec.
It is worth remembering that the complaint did not come from the Frambach family, but from the Commission for the Fight against Religious Intolerance of the State of Rio de Janeiro, in collaboration with the Center for the Articulation of Marginalized Populations (CEAP).
After the repercussions of the case, Silvana Taques argued for the program “Fofocalizando” (SBT) that the term “macumbeiros” was used in a moment of vulnerability: “These words were said in a moment of extreme sadness and she had no intention of causing offense.”
In a statement to the police, AndrĂ© Frambach said he only learned of such a message when Larissa was starting negotiations to be interviewed on “FantĂ¡stico” about the situation with her parents. The couple’s agreement was not to disclose Silvana’s statements about the Frambach family and he claims he does not know who or how the message got to the press.
Larissa and her mother did not go to the police station to give statements about the case.
