BRASÍLIA – Minister of the Federal Supreme Court (STF) Dias Toffoli has canceled the ruling of the Federal Court of Auditors (TCU) which had suspended the payment of almost 1 billion reais in payments to federal judges. The decision was made on Tuesday 19th.

The situation highlighted a conflict between the TCU and the National Council of Justice (CNJ), which approved the payment of the benefit. The national justice inspector, Luís Felipe Salomão, accused the Court of Auditors of meddling in the Council’s affairs.
“I understand that it is not up to the Federal Court of Auditors to override, in this specific case, the constitutional competence attributed to the National Council of Justice, entering into the merits of the agreement expressed by the latter, under penalty of offending the independence and unity of the Judiciary”, writes Toffoli.
It is the same argument used by the former Attorney General of the Republic (PGR) Augusto Aras, who also defended the federal judges. “The Federal Court of Auditors is not the universal defender of the treasury and public assets,” Aras underlined in August.
The Federal Attorney General’s Office (AGU) is expected to appeal Toffoli’s decision. This is because President Lula (PT) has already expressed dissatisfaction with the CNJ’s decision that issued penduricalhos to the STF and TCU ministers. The Minister of Finance, Fernando Haddad, told his interlocutors that there is no fiscal effort that can support this junk factory of the Judiciary.
