The Decree establishes the National Policy on Cybersecurity

Brasilia – O federal government amended Decree, published in the Official Journal of the Union (DOU) this Wednesday 27, which establishes the National Cyber ​​Security Policy (PNCiber) and the National Committee for Cyber ​​Security (CNCiber). PNCiber aims to lead the country’s cybersecurity effort.

According to the text, its principles will be: national sovereignty and the priority of national interests; the guarantee of fundamental rights, in particular freedom of expression, protection of personal data, protection of privacy and access to information; the prevention of cyber incidents and attacks, in particular those aimed at national critical infrastructures and essential services provided to society; the resilience of public and private organizations to incidents and cyber attacks; training and technological development in cybersecurity; cooperation between public and private bodies and organisations, in the field of cyber security; and international technical cooperation in the area of ​​cybersecurity.

The National Cybersecurity Strategy and the National Cybersecurity Plan are PNCiber tools. The CNCiber, established by Decree, within the Chamber of Foreign Affairs and National Defense of the Government Council, will have the aim of monitoring the implementation and evolution of the PNCiber. CNCiber has the task of: proposing updates to the PNCiber, the National Cybersecurity Strategy and the National Cybersecurity Plan; evaluate and propose measures to increase cybersecurity in the country; make proposals to improve the prevention, detection, analysis and response to cyber incidents; propose measures for the development of cybersecurity education; promote dialogue with federation bodies and society on cybersecurity issues; propose collaborative strategies for the development of international technical cooperation in the field of cybersecurity; and express opinions, at the request of the President of the Chamber of Foreign Affairs and National Defense of the Government Council, on issues relating to cybersecurity.



Participation in the CNCiber and the working groups, pursuant to the Decree, will be considered the provision of an important public service and, therefore, will not be remunerated. The Office for Institutional Security of the Presidency of the Republic will chair the CNCiber and will be the executive secretary of the CNCiber. A representative of the Civil Chamber, the Union Comptroller General, the Ministry of Science, Technology and Innovation must also be part of the Council; Ministry of Communications; Ministry of Defence; Ministry of Development, Industry, Trade and Services; Ministry of Education; Ministry of Finance; Ministry of Management and Innovation in Public Services; Ministry of Justice and Public Security; Ministry of Mines and Energy; Minister of Foreign Affairs; the Central Bank; the National Telecommunications Agency – Anatel; the Internet Steering Committee in Brazil; three by civil society entities with activities related to cybersecurity or the guarantee of fundamental rights in the digital environment; three from scientific, technological and innovation institutions related to the cybersecurity sector; and three from bodies representing the business sector linked to the area of ​​information security.

The CNCiber meetings will take place on an ordinary, quarterly basis and may be convened by the Prime Minister on an extraordinary basis.
