The young man who accused Daniel Alves of rape will sue his mother for publishing images

The victim of the alleged rape committed by former player Daniel Alves decided to file a complaint after the athlete’s mother, Maria Lúcia Alves, exposed her face and name in a publication made on social media, although the case remained under judicial secrecy.

On December 30, Maria Lúcia used social media to denounce the victim accusing her son of rape. In the publication, the former footballer’s mother shows images of the young girl having fun with friends at parties and wonders if the victim was really traumatized by her abuse.

Until then, the victim’s identity had remained confidential by order of the Spanish justice system. “Here is the celebration of her, who claims the inability to work and the significant deterioration of her daily activities after the ‘trauma’,” Maria Lúcia wrote in the video.

In a note sent to the Spanish newspaper El Periodico, the victim’s lawyer, Ester García, stated that “the dissemination of images or any information that allows the identification of a victim of sexual violence constitutes a flagrant crime.” She also informed that “legal action will be taken against any person or media that disseminates images of our client or provides any information, direct or indirect, that allows her identification.”

The Brazilian Women’s Union (UBM) has also formalized a request to the Federal Public Ministry (MPF), asking for the opening of a criminal investigation against Daniel Alves and his mother.

Maria Lúcia is accused of having committed a crime of violence against women, as established by article 147-B of law no. 14.188/21 of the Brazilian Penal Code, which talks about “causing emotional harm to women that harms them and disturbs their full development”. or that aims to degrade or control your actions, behavior, beliefs and decisions, through threats, embarrassment, humiliation, manipulation, isolation, blackmail, ridicule, restriction of the right to come and go or any other means that causes harm to your psychological health and self-determination.”

By violating the victim’s confidentiality, Maria Lúcia Alves, if convicted, risks a sentence of six months to two years in prison, as well as a fine.

The crime of which Daniel Alves is suspected took place on 30 December 2022 in a nightclub in Barcelona. The player has been in prison since January 20 last year and his trial will take place between February 5 and 7.

Rape

Provided for by article 213 of the penal code, the crime is punishable by 6 to 10 years in prison whoever “forces someone, with violence or serious threat, to have carnal intercourse or to carry out or allow another libidinous act to be carried out” with them” .
