The Attorney General of the Republic, Paulo Gonet Filho, defended that an action in which Jefferson is responsible for crimes against the National Security Law be judged by the Supreme Court
BRASÍLIA – The Attorney General of the Republic, Paulo Gonet Filhodefended this Thursday, 18, an action in which the former federal deputy Robert Jefferson (PTB) is accused of crimes under the National Security Law and is being tried in the trials of anti-democratic acts of January 8 in which they are processed Federal Supreme Court (STF). According to Gonet, the former parliamentarian constituted an “important link” in the “machine” of the attacks on the buildings of the Three Powers.
In 2022, the STF named Jefferson as a defendant for alleged defamation and racist practices, as well as inciting crimes covered by the old national security law. At the time the Court ordered that the case be sent back to the Federal Court Federal District. To the Attorney General of the Republic (PGR)the charges link the former parliamentarian to the January 8 investigation.
“Can the facts attributed to the accused Roberto Jefferson be considered a relevant link in this mechanism that led to the violent acts of January 8, 2023?”, said Paulo Gonet.
The attorney general also stated that Jefferson used the party structure of the PTBacronym chaired by the former deputy between 2016 and 2021, to attack democratic institutions.
“This perspective is strengthened by the consideration attributed to the accused, in addition to having used part of the party structure financed by the treasury to weaken the institutions of the Republic, of having publicly formulated murky verbal attacks against the central institutions of the Democratic Republic, in attempt that the vision of the moment allows us to situate it as a strategy aimed at promoting a movement of reprehensible disintegration of the political order”, underlined the Attorney General.

Moraes asked that the Jefferson justices’ action remain at the STF due to the “direct connection” to Jan. 8
On the 5th, Minister Moraes, rapporteur of the proceedings relating to January 8th at the STF, filed an order asking whether the appeal against Jefferson should be evaluated by the Supreme Court. According to the judge, there is no doubt about Jefferson’s “direct link” to “the criminal acts that led to the invasion and plunder” of the buildings of the Three Powers.
In the document, Moraes points out that the Supreme Court’s decision to refer the appeal to the DF Court was made before another Court decision. After January 8, the jurisdiction of the STF was established to conduct investigations into alleged crimes of terrorist acts, threats, persecution, armed criminal association, coup d’état, and violent abolition of the democratic rule of law committed during anti-democratic attacks.
With the PGR’s favorable declaration, the STF’s jurisdiction over Judge Jefferson will be discussed by the Full Court. The Supreme Court has been on recess since December 20 and is expected to resume its activities in early February.
Moraes has held Jefferson in pretrial detention, detained since October 2022
On December 16, Moraes maintained Jefferson’s pretrial detention. The former deputy has been in pre-trial detention since October 2022 when he received the order Federal Police with rifle shots and grenades in Rio, on the eve of the second round of the presidential elections. He has been hospitalized in a private hospital since March last year and his defense claims that his health is poor.
Moraes declared that the conduct accused of Jefferson is “very serious” and that there has been no recent event that could “pollute the presuppositions and foundations of the decision which decreed preventive detention”. The judge also stressed that the arrest of the former deputy is necessary to “ensure public order” and classified his “belligerent behavior”.
“Needless to say, however, his belligerent behavior and aversion to carrying out court orders have ceased, considering that he is currently hospitalized,” the minister stressed.
