Samarco’s renegotiation will resume soon and will result in a fine of 47 billion reais


The deal was expected last year, but negotiations were suspended in December

Negotiations to renegotiate compensation related to the Samarco dam accident, whose partners are the mining companies Vale and BHP, have taken the first steps towards recovery. The Federal Regional Court of the 6th Region (TRF-6) has already started holding online meetings with those involved and BHP said in a statement that it expects them to resume next month.

The deal, expected to close last year, was put on hold in December. Mining companies offered R$42 billion for remedial measures, while authorities requested R$126 billion. Vale does not expect deadlines for the renegotiation, but says it is available to the TRF to resume talks.

If implemented, the renegotiation will cover actions such as the decision issued yesterday, the 25th, by the 4th Federal Court of Belo Horizonte, which established the payment of R$47.6 billion for collective moral damages due to the collapse of the Mariana dam. This fine is part of a larger process, which requires compensation of R$155 billion and will be included in the renegotiation.

The Federal Regional Court has started to hold meetings

TRF-6 reported that, after the year-end break, the first meetings with representatives of Samarco, Vale, BHP and the public authorities of Minas Gerais took place in mid-January. Meetings will soon be scheduled with representatives of the Union and the public authorities of Espírito Santo to resume negotiations.

Even if the hammer has not been hammered on the values, the main lines of the agreement have already been defined unanimously, Judge Ricardo Rabelo, of TRF-6, told the deputies following the matter.

The renegotiation covers issues such as strengthening the region’s public health system, building infrastructure and basic sanitation work, conducting studies to assess environmental contamination and paying financial aid.
