If successful, the Brazilian would not be extradited, which is why requests for bail were rejected by the Spanish court.
An inmate who shared a cell with Daniel Alves said the player planned to flee to Brazil if he was granted bail in the case accusing him of raping a woman in a Spanish nightclub. The Brazilian has been in prison since January 20.
The information was released by the Telecinco broadcaster, which did not reveal the identity of the prisoner.
— As soon as they granted him parole, he would have fled to Brazil — guarantees the man, who confirmed that the plan was revealed to him by the Brazilian.
Indeed, Daniel Alves’ defense made three requests for parole, but none of these were accepted by the Spanish courts. The body argued that there was a risk that the Brazilian would escape and not serve a possible sentence, since Brazil and Spain do not have an extradition agreement and the Brazilian Constitution prohibits the extradition of native Brazilians.
Something similar happened with Robinho. The Brazilian had been sentenced to nine years in prison in December 2020, in Italy, again for a rape case, but the former AC Milan striker was not in the country to serve the sentence: he returned legally. The Italian government has unsuccessfully attempted extradition and is now demanding that the former player be allowed to serve his sentence in Brazil.
Judgment
The trial against Daniel Alves took place from 5 to 7 February this year and around 30 witnesses, both defense and prosecution, were heard in the Barcelona court.
The Prosecutor’s Office is asking for the former Blaugrana full-back to be sentenced to nine years in prison, followed by another 10 years of probation. The request also includes the payment of 150 thousand euros (just over 800 thousand reals) to the victim.
The decision has not been announced and there is no deadline for this to happen. The Spanish press speculates that the sentence should be announced within a month. The player remains in prison.
