In the world of work, Disgusting Leave is an often unknown but extremely important right. This benefit guarantees employees a period of absence from work in the event of the death of a close family member, ensuring the necessary mourning period.

To better understand this legislation, Luana Horchuliki, head of people and management at Gupy, a human resources technology company in Brazil, listed the five main points for understanding the Nojo License. Watch:

It’s time to face the losses

Disgusting Leave is a right that allows workers to take leave of up to 2 consecutive days in the event of the death of close family members, such as a spouse, parents, children, siblings or dependents. Some companies work more days depending on how the collective agreement is structured.

No impact on salary

According to labor law (Article 473 of the CLT), absence during Nojo Leave does not lead to financial losses for the employee.

Family coverage

“All workers under the CLT regime are entitled to this benefit, including direct family members. Conventions or collective agreements can extend this right to non-direct relatives, including homosexual ones and stable union relationships”, explains Luana.

Immediate start

The duration of the Nojo License starts from the day following death, being consecutive and including public holidays. The period varies: 2 consecutive days for CLT, 8 days for public employees and 9 days for teachers.

Simple procedure

“To apply for the Nojo License, simply report the death to the Human Resources department and, upon return, present the death certificate. In the case of a spouse, documents proving the relationship are required,” he explains.

Why is it called the Disgust License?

The term “disgust” in this context originates from the Portuguese language, linked to feelings of mourning, anguish and deep sadness, differing from the Brazilian conception of the word.

“This is a fundamental right, which guarantees respect for workers and provides an adequate time to deal with difficult losses,” concludes Luana.
