The case of Klara Castanho, who donated a rape child and her confidentiality was violated, is inspiring a state bill in São Paulo. State deputy Erica Malunguinho presented the project on Monday (27/6), at the Legislative Assembly of Sao Paulo, with the aim of guaranteeing confidentiality for pregnant women – cis women and trans men – who choose to legally transfer the child protection on the 3rd.

The law, in addition to guaranteeing the secrecy of information on the birth and delivery of the child for adoption, provides for sanctions for those who leak the information, including health and social services.

One of the articles also states that “the pregnant person who chooses to have the direct childbirth for adoption must be treated cordially by the professionals who assist her, without her decision being confronted at any time”.

According to the text of the protocol, failure to comply with this law, if passed, will result in fines ranging from approximately R $ 16,000 to R $ 48,000, in addition to the suspension of the state license to operate for 30 days in the event of a repeat offense.

“Although confidentiality is guaranteed by law, there is no administrative liability in the event of any violation,” Malunginho wrote on Twitter.

He also informed that the project is part of a joint action at the national level, in a proposal that includes other state assemblies across the country.

The deputy intends to name the law after the actress, but only if Klara Castanho approves the idea.
