RJ judge pushes Netflix to stop using technology; understand the case

The Rio de Janeiro Court of Justice has filed an injunction against Netflix, asking the company to stop using video compression technology.

The technology in question is called DivX, and TJ-RJ accuses Netflix of using it without obtaining a license. Therefore, Netflix would exploit a technology protected since 2018 in Brazil, by registering with the National Institute of Intellectual Property.

The injunction requires Netflix to stop using DivX and the deadline expired on Friday, June 24th. Otherwise, Netflix will be charged a daily fine of BRL 50,000. This is not a new issue for Netflix, which has already faced a court order on the same matter, which was overturned in 2021 and is now back.

Now, the injunction has been reinstated by the judges of the 24th Civil Chamber of TJ-RJ, with two votes in favor and one against. DivX, also an American company, accuses Netflix of infringing its patent in Brazil, arguing that the streaming company uses its unlicensed technology.

DivX is a patented technology that allows for the compression of high definition video at faster speed and without compromising image quality. Therefore, it is possible to deliver videos in Ultra HD and 4K with higher definition.

On the other hand, Netflix denies making use of DivX, which was denied by the software developer, who submitted five technical opinions indicating that the streaming giant is using the technology as evidence to TJ-RJ.

But, despite denying the use of the technology, Netflix says the court’s decision to stop using DivX will cause enormous damage to the company – a contradiction that was even used as an argument in the judges’ decision.
