Robinho will spend the first ten days in Tremembé II Penitentiary, 160 kilometers from Sao Paulo, under the inclusion regime. The procedure is standard when a new inmate arrives at the penitentiary. After this period the former footballer will be able to be integrated with the other prisoners. He was arrested after the Superior Court of Justice (STJ) approved the player’s conviction for raping an Albanian woman in Milan in 2013. The former Santos and Brazilian national team striker declares his innocence.

The cell where Robinho is located is eight square meters, 2mx4m. According to the Secretariat of the Penitentiary Administration (SAP-SP), the space is intended for a maximum of two people. Robinho, however, is alone for now. This place serves as an introduction to the prison. SAP-SP Resolution 144 of 2010 defines that the period of inclusion can last up to 10 days. Then there’s time for observation, up to 20 days. Therefore, it is possible for an inmate to spend a month isolated from others. But Robinho will spend 10 days in a separate cell, we read in a note from the secretariat, before being integrated into the penitentiary.

During the observation period, after inclusion, the former player has the right to a hearing with the lawyer representing him, José Eduardo Alckmin. At this time Robinho is also entitled to visits of up to two hours. Among the obligations, the resolution provides for measures upon entry, for people transferred or arrested by the Federal Police, such as cutting their hair with a number 2 comb on the sides and a number 4 comb on top. Beards and mustaches should also be shaved.



On the first day, anyone who arrives as an inmate goes through the photo and fingerprint identification register, changes their ordinary clothes into the standard uniform and hands over all items they have with them that are not allowed in the penitentiary. An inventory is drawn up for restitution after serving the sentence. Inmates are provided with personal hygiene and cleaning materials.

Robinho’s food is provided individually, but follows the prison standard for all inmates. They are entitled to four meals a day: breakfast, lunch, dinner and an optional snack. During the observation period the prisoner cannot carry out educational or work activities. This can be resumed later, when the integration has already been carried out.

Sunbathing is a right guaranteed to prisoners. In the normal system, they last up to two hours. SAP-SP did not say how long this activity might take for those who are adapting. However, it occurs in a different period than that expected for other prisoners. In the Tremembé II penitentiary there is a library, a classroom and laboratories. The place also allows football matches and artistic practice and guarantees freedom of religious worship. In total, the capacity of the penitentiary is 584 people (348 in closed regime, 188 in semi-open regime and 48 in prisons due to child support debts).

The Tremembé Complex is recognized for having taken in “famous prisoners”. It is there that Suzane von Richtofen is found, convicted for the death of her parents, the brothers Cristian and Daniel Cravinhos, who participated in the crime, and Anna Carolina Jatobá and Alexandre Nardoni, guilty of the murder of Isabella Nardoni, for example. The list is even longer.

Robinho was sentenced to nine years in prison by the Italian justice system for rape. When the case became final, he was in Brazil and could not be arrested or extradited. This week, STJ understood that the former player may serve his sentence in Brazil. The defense can still appeal to the STJ and STF to obtain Robinho’s release. However, he would still be found guilty and sentenced for the crime.
