He was sentenced to four and a half years in prison
Released from prison after having paid a bail of 1 million euros (about 5.45 million reais), Daniel Alves will be able to remain free for a year pending the appeal in the case that convicted him in the first degree of rape in Spain.
There is not yet a precise date for the trial in which the sentence can be defined, but, since the case will have to go before the Superior Court of Justice and, possibly, the Federal Supreme Court, which is probable, according to the newspaper “Marca” , is that the final decision will only arrive at the beginning of 2025.
To date, Daniel Alves’ sentence is four and a half years in prison. Since he has already served 14 months of this sentence, and according to Spanish law pre-trial detention cannot exceed half of the sentence (27 months), that is, it will take approximately 13 months to pronounce the final sentence.
Daniel Alves was arrested on January 20, 2023 and has since only been released to attend the trial in February this year. Despite being free, the former player has had his Brazilian and Spanish passports withheld and will have to appear in court every Friday or, if that day is a public holiday, Thursday, as will happen this year at Easter.
Until the sentence becomes final, and until there are changes in the court’s criteria, given that the Prosecutor’s Office has opposed his release, the right-back will enjoy this provisional freedom. The days of provisional release do not count towards the possible sentence.
Daniel Alves’ sentence is not yet final, as an appeal is underway at the Superior Court of Justice of Catalonia. If either party is unhappy with this decision, there will be yet another possible scenario to turn to: the Federal Supreme Court. In this case, neither the parties, nor the Brazilian nor the Public Prosecutor, would have any more instances to appeal to and the decision would be considered final.
