Minister Alexandre de Moraes, of the Federal Supreme Court (STF), rejected on Tuesday 9th the request of X in Brazil to be exempted in case of failure to comply with court orders.

In his decision, Minister Alexandre de Moraes says the office is an “indispensable link” for the operation of the platform in Brazil, but seeks to “exonerate itself from any responsibility” for the STF’s orders. He further stated that the request “reveals a certain cynicism” and “borders on bad faith litigation.”
“The appellant company seeks a genuine jurisdictional immunity clause,” the minister wrote. “The fact that one of the so-called international operators is part of its members suggests an abuse of legal personality, since it could choose not to comply with the determinations of the Brazilian Court without suffering any consequences, covered up by its representative in Brazil.”
The minister also clarifies that X representatives in Brazil can be punished in civil and criminal matters if they do not comply with court orders. Responsibility, according to the decision, is “unequivocal”.
