The STF suspends the competitions due to the limited number of places reserved for women


The Federal Supreme Court has suspended competitions in nine states; For those registered with Via Advocacia, candidates can take legal action if they find irregularities on the part of the examining commissions

A court decision has suspended the competitions for Prime Minister (Military Police) and Fire Brigade in the DF (Federal District) and nine states of the country due to the discrepancy in the number of opportunities for men and women.




The Prime Minister of Minas Gerais, for example, opened a competition for 2,901 places for the soldiers’ training course, which included 2,611 places for men and only 290 for women.

In response, the Attorney General’s Office appealed to the STF (Federal Supreme Court). Supreme Court Minister Nunes Marques suspended the competition, which would have been held on March 10. According to ministers, the rule of reserving a minority of vacancies for women is unconstitutional.

Following the same premise, since the beginning of 2024, the Supreme Court has also considered unconstitutional the military competition notices in the DF and in the states of Ceará, Goiás, Mato Grosso, Pará, Paraíba, Piauí, Rio de Janeiro and Santa Catarina.

“The suspension of the competitions for PM and firefighters by the Court is based on the decisions of the STF (Federal Supreme Court) which guarantee gender equality and the prohibition of discrimination in public competitions”, underlines Dr. Lindson Rafael Silva Abdala , partner of Via Advocacy, a law firm specializing in public procurement and public employees.

“The STF has consolidated jurisprudence on the need to respect the principles of equality and non-discrimination,” he says.

A United Nations (UN) report called the Gender Social Norms Index, which covers 85% of the world’s population, indicated that 90% of respondents have some kind of prejudice against women – in Brazil, according to the survey , 84.5% of the population have some type of prejudice against women.

Competitors and servers can assert their rights

Abdala explains that women who feel harmed by the limitation of places in the PM and firefighter competitions can base their legal actions on STF decisions that recognize gender equality as a fundamental right.

“The FST has jurisprudence in favor of equal opportunities and the fight against gender discrimination, which could strengthen the case of women harmed by the limitation of vacancies,” she explains.

The lawyer notes that, mindful of this premise, Via Advocacia was created with the aim of assisting public candidates and public employees in their claims against offenses committed by the public administration and examination commissions.
