Senate approves quota for Brazilian works in streaming

The Economic Affairs Committee (CAE) of the Senate approved on Tuesday (16) a new bill that establishes a quota for the production of Brazilian content in all streaming services operating in the country. As released by Agência Senado, the PL regulates video on demand services, as well as stimulating the consumption and production of national works.

Platforms with two thousand works, for example, will have to make available at least 100 Brazilian productions. Whoever has 7 thousand titles will have to offer at least 300 national ones. Half of them must be content produced by independent producers. The national quota will come into force gradually and only after 8 years will 100% compliance be required, carried out by Ancine“, explained the rapporteur of the proposal, Senator Eduardo Gomes, of the PL of Tocantins.

In a letter sent to senators, representatives of the audiovisual sector questioned some points of the report and asked, for example, that Brazilian content have a consistent catalog share, since it is normal for platforms to withdraw availability from time to time of their titles.

According to Senator Humberto Costa there are still other reservations, as the type of partnership will be “use of public money to subsidize already billion-dollar platforms”.

I cannot agree with the idea that a simple partnership between a video on demand platform and a Brazilian company can be considered Brazilian production. NO! It is necessary that independent Brazilian production receives differentiated treatment in this regulatory process, as happens in other countries around the world. We cannot create loopholes for public money to subsidize platforms that are already billions in several countries and which, including Brazil, is one of its most important markets.

It is worth noting, as O Globo reminded, that several platforms, such as Netflix, Prime Video and Max, already invest in original content in Brazil, which should facilitate adaptation to the new rule.

The deadline for returning the Review House proposal was not announced.
