Last Tuesday the CBF decided to postpone the matches of the Rio Grande do Sul clubs to the 27th of this month, but there is strong internal pressure for a resolution on all matches of each of the next rounds of the Brazilian Championship and also of the Copa do Brazil.

From a legal point of view, is there support in the Brasileirão regulations for CBF president Ednaldo Rodrigues to suspend or paralyze the championship due to an environmental tragedy, as happened in Rio Grande do Sul? The lawyer specializing in sports law at Ambiel Advogados, Felipe Crisafulli, clarified that the regulations of the competitions organized by the body do not specifically address this issue.

– The General Competition Regulations (RGC) of the CBF do not provide for the suspension or interruption of tournaments due to weather problems, even extreme ones, such as those we saw in Rio Grande do Sul last week. In any case, this should not prevent the CBF from making this type of decisions, if it deems it right and necessary – the expert underlined.

Crisafulli added that in the CBF RGC there are also possibilities to modify the scoreboard and change the matches, as well as transfer stadiums, schedules, etc., “due to force majeure”, but it is not about the suspension of the championship as a measure Total.

– Likewise, the Special Competition Regulations (REC) of the Serie A 2024 Brasileirão provides, in its article 35, paragraph 2, that the dates and rankings may be modified due to causes of force majeure, pandemic or exceptional reasons, but not doesn’t even mention the suspension of the competition itself – he reflected.

Given this situation, the CBF could still change the table and therefore suspend the championship, moving the matches to the following weeks or months.

– There will certainly be difficulties with the dates for holding the games; on the other hand, there is a possible technical imbalance, in addition to practical impossibilities, including access and travel, which must be observed by the CBF if it chooses, at a certain point, to temporarily suspend the championship and postpone some matches, thinking always on the alternatives to the Rio Grande do Sul clubs and in the best way to impact as little as possible on the Brazilian football product, including economic activities of national and international repercussions and importance – stated Crisafulli.

With Libertadores and Sul-Americana, Conmebol’s mission is even more complex, as it involves clubs from different countries, spread across the continent, with fewer dates available for clashes.

– One possibility could be to use the Copa América period to host these matches, given that South American club competitions have no matches scheduled during this period – suggested Crisafulli.

In any case, as happens at a national level, neither the Club Libertadores Manual nor the Americana Club Manual provide for the possibility of interrupting competitions.
