According to the president of the Court of Auditors, the lack of responses from the municipal management makes it impossible to continue the testing work; City Hall says the requested documents will be provided within the stipulated deadline

OR Municipal Audit Court (TCM) approved a notice for the City of São Paulo on Wednesday 8th, requesting clarification on a project to canalize a watercourse in the Ribeirão Perus region, north of the capital. Initially set at R$130 million, the contract was readjusted, reaching R$161.7 million. Due to the high value, the contract is verified by the TCM.




The Court gave the Municipal Secretariat of Infrastructures and Urban Works (SIURB) a deadline of five days for the entity to deliver the documentation required by the verification, under penalty of liability, the application of a warning sanction and a pecuniary sanction to the responsible. The first request made to the Ministry was sent in October 2023, with subsequent letters and deadlines already expired, without any response to date.

Wanted by Estadao, the SIURB clarified in a note “that all documents requested by the Court of Auditors of São Paulo will be provided within the deadline established by the Court”. However, the municipal management did not explain why TCM’s previous requests had not received a response.

According to the rapporteur on the matter, Presidential Advisor Eduardo Tuma, the lack of responses from SIURB makes it impossible to continue monitoring the execution of the employment contract in Ribeirão Perus. “Ultimately, this constitutes an obstacle to the exercise of external control attributed to this Court of Auditors by constitutional and legal provisions,” he said.

Signed in April 2023, the contract between SIURB and JDP Ribeirão Perus provides for the canalization of waterways associated with the construction of flood dampening basins and the raising of the Ribeirão Perus bridge crossings. The work was targeted by the TCM due to the value of the contract, as all contracts above R$100 million are automatically analyzed by the Court.

However, TCM says it is unable to continue the inspection work, as the city administration does not respond to letters from the audit team. After unsuccessful attempts to contact via email, the office of the Secretary of Infrastructure and Urban Works, Marcos Monteiro, was contacted on March 5, 2024 and asked for 15 days to send the documents, but, to date, it has not been envoy .
